Terms and Conditions

1. Who I am
The website kirabat.art and its online shop are run by Kira Shabanova PR Beograd, Višegradska 1, 11000 Belgrade, Serbia. Registration number (MB) 67990820, tax identification number (PIB) 114968522, registered with the Serbian Business Registers Agency (APR). Not registered for VAT (PDV). Email hello@kirabat.art, phone and WhatsApp +381 62 8242 306.
In these terms, "I" and "the artist" mean Kira Shabanova PR; "you" means the person buying through this website.
2. Scope
These terms apply to all purchases on kirabat.art. By placing an order, you accept them. If you buy as a consumer and the law of your country gives you stronger rights, those rights still apply.
3. The works
Every painting is an original, one of a kind, signed and sold with a certificate of authenticity. I photograph each work as faithfully as possible, but colours, metallic leaf and texture can look slightly different on screens. Small irregularities of the surface are part of the handmade character of the work and are not defects.
4. Prices
Prices are shown in euros (EUR). As I am not registered for VAT, no VAT is added. Shipping is calculated at checkout. Customs duties and import taxes are calculated separately (see Delivery & Payment).
5. Ordering
Add a work to your bag, go to checkout, enter your delivery details and pay through PayPal. You will receive an email confirming your order; the contract between us is concluded when this confirmation is sent.
Every work exists only once, so it is reserved for you only after payment. If two orders for the same work arrive at the same time, the first paid order is accepted and the second buyer receives a full refund straight away.
6. Payment
Payment is made through PayPal (PayPal balance or card). I never see or store your card details.
7. Delivery
Works are shipped from Belgrade within 5 business days after payment, tracked and insured. The risk of loss or damage passes to you when the work is delivered to you or to a person you have named.
8. Right of withdrawal
If you buy as a consumer, you can withdraw from the purchase within 14 days of receiving the work, without giving a reason.
To withdraw, send me a clear statement by email to hello@kirabat.art — for example: "I withdraw from my purchase of [title], ordered on [date], received on [date]", with your name and address. Then send the work back within 14 days, in its original packaging and condition, to Kira Shabanova PR, Višegradska 1, 11000 Belgrade, Serbia.
The cost of returning the work is paid by you; please ship it tracked and insured. I refund the price of the work and the standard shipping within 14 days of receiving your withdrawal, through PayPal, and may wait with the refund until the work has arrived back. You are responsible for any damage caused by handling the work beyond what is needed to look at it.
Commissioned works are made to your personal specifications, so the right of withdrawal does not apply to them.
9. Complaints
If a work arrives damaged or has a defect that was not described, write to me at hello@kirabat.art. I confirm every complaint within 8 days and resolve it within 15 days — by repair, replacement or refund.
10. Commissions
Before I start, we agree in writing on the size, subject, medium, price and timing. A deposit of 50% of the price starts the work; it is non-refundable once the work has begun.
Two rounds of changes are included at the sketch stage. After the painting has started, only small adjustments are possible. I share progress photos along the way. The remaining 50% is paid when the work is finished, before shipping.
11. Copyright
Buying a work gives you ownership of the physical painting; the copyright stays with the artist. The work may not be reproduced — as prints, merchandise, digital or commercial use — without my written permission. I may show the work in my portfolio, exhibitions and publications, credited as "Private collection" unless you agree to your name.
12. Liability
I am liable under Serbian law. Nothing in these terms limits your statutory rights as a consumer.
13. Governing law and disputes
These terms are governed by the law of the Republic of Serbia. If you are a consumer living in another country, you keep the protection of the mandatory consumer laws of that country.
If we cannot resolve a disagreement together, you can turn to an out-of-court consumer dispute resolution body; the list is published by the Ministry of Internal and Foreign Trade of the Republic of Serbia. Otherwise, the competent court in Belgrade decides.
14. Changes
I may update these terms. The version published on the date of your order applies to that order.
